Attorney Donald Bartell, who was instrumental in spearheading the California DUI Lawyers Association's lawsuit against the DMV, was quoted in the Press Enterprise regarding the recent Court of Appeal decision regarding the case. The Court of Appeal decision held that the DMV's DUI administrative hearings are unconstitutional because of the dual-role the DMV hearing officers have in the hearings, and the ability of DMV managers to unilaterally and without participation of the licensees to change the decisions of the DMV hearing officers.
